Article 22 of the Constitution of India provides for the protection against arrest and detention in certain cases.

— No person who is arrested will be detained in custody without first being notified of the reasons for his arrest, nor may he be denied the right to speak with and be represented by a legal practitioner of his choosing.

— Every person arrested and detained in custody must be brought before the nearest magistrate within twenty-four hours of arrest, excluding the time required for the journey from the place of arrest to the magistrate’s court, and no such person may be held in custody for more than twenty-four hours without the authority of a magistrate. Hence, statement 1 is correct and statement 2 and 3 are not correct.

Therefore, option (a) is the correct answer.

2. (b)

— An adjournment motion is a motion for discussing a specific and important matter that should have urgent consideration. Hence, statement 1 is correct.

— It can be moved by any member of the House and is essentially an emergency resolution of censure against the government. Hence, statement 2 is not correct.

— The goal is to attract the Government’s attention to a problem of urgent public interest in order to criticise the Government’s choice in an urgent matter in which a motion or resolution with adequate notice would be too late. Hence, statement 3 is correct.

5. (c)

FYI:

Article 39-A of the Constitution of India provides for equal justice and free legal aid.

— The State shall secure that the operation of the legal system promotes justice, on a basis of equal opportunity, and shall, in particular, provide free legal aid, by suitable legislation or schemes or in any other way, to ensure that opportunities for securing justice are not denied to any citizen by reason of economic or other disabilities.

Therefore, option (c) is the correct answer.
